Early development
Paperwhales is an early, evolving preview. Features may be incomplete or not fully working, and may change, pause or be removed without notice — camera and face tracking features especially. During development the service is provided as-is and as available, to the extent the law allows. Keep your own copies of anything important to you.
1. About these terms
Paperwhales is an experimental shared city for writing, AI-assisted music and community radio. These terms apply to the site, guest participation, accounts, creations and related Paperwhales broadcasts. Read the Music rights, Privacy and AI safety policies alongside these terms. Mandatory consumer and data-protection rights always take priority.
Use the service only if you can legally agree to these terms. Where local law requires a parent or guardian's permission, obtain it before participating. The service is not designed for young children.
2. Accounts and the shared city
Keep your sign-in details secure and do not impersonate others or evade a restriction. You are responsible for what you submit and for activity you authorize. Guests may keep drafts and preferences on their device; an account is needed for some creation features.
Public towers, finished creations, display names and activity in shared spaces can be seen by others. Do not submit private information you would not want published or broadcast. Unfinished music progress is intended for its creator and authorized administrators, not the public.
3. Your submissions
You keep any rights you already hold in your original prompts, writing and uploaded material. Submit only material you own, have permission to use, or can lawfully use for this purpose. A citation alone is not permission, and public availability does not make a work public domain.
You grant Paperwhales a non-exclusive, worldwide, royalty-free license to process, reproduce, adapt, host and display submitted material as needed to provide the service and make the creations you request. For material you choose to submit for a public creation, this also includes incorporating it into that creation, promoting it, and performing or broadcasting it through Paperwhales radio, YouTube and other Paperwhales channels. Service providers may exercise this license only as needed for those purposes. This is not a transfer of ownership of your pre-existing work.
4. Generated music and broadcasts
To the extent rights exist and Paperwhales can lawfully hold them, Paperwhales retains rights in music generated through the service. You receive the personal, non-commercial permission described in Music rights, not ownership, an exclusive copyright or a commercial distribution license.
Finished music may be selected for our live YouTube channel, community radio, other live channels, promotional excerpts and archives. Selection is not guaranteed and does not create an entitlement to payment or royalties unless separately agreed. Private drafts, passwords, account email addresses, camera video and microphone audio are not authorized for public broadcast merely by this music clause; camera and microphone sharing require their separate controls and permissions.
5. Acceptable use
Do not submit unlawful or infringing content, child sexual exploitation material, threats, targeted harassment, hate targeting protected groups, sexual content involving minors, scams or malicious code. Do not expose someone's private data, impersonate a real person deceptively, or request unauthorized voice imitation.
Do not bypass access controls, scrape private data, interfere with other players, abuse paid generation resources or manipulate posting queues. See AI safety for reporting and moderation principles.
6. Removal, availability and charges
Paperwhales may remove generated music or other content for rights complaints, safety, storage, service changes or legal obligations, and may restrict accounts for abuse. Where appropriate and lawful, we will explain a moderation decision and allow a review request. Keep personal copies where downloads are offered; the service is not a permanent archive.
Generation, playback, posting and live broadcasts can fail or be interrupted. Do not rely on the service for emergencies or professional decisions. No fee is created by these terms: any paid offer must show its price and applicable payment, cancellation and refund terms before purchase.
7. Responsibility and disputes
AI outputs may be inaccurate, similar to existing works, offensive or unprotectable by copyright. No guarantee of originality, availability or commercial clearance is made. Third-party platforms apply their own terms.
To the extent allowed by law, the experimental service is provided as available. Nothing excludes liability that cannot lawfully be excluded, including applicable rights relating to fraud, intentional misconduct, personal injury or statutory consumer remedies. Contact us first about a dispute; these terms do not impose mandatory arbitration or waive access to competent courts or regulators.
8. Changes and contact
Material changes will be identified by an updated date and, where required, an appropriate notice or renewed agreement. Changes do not retroactively remove mandatory rights. The service is provided by Paperwhales (Independent Developer), represented by Earthia One and based in Cantabria, Spain. Contact & reporting lists the official Paperwhales channels and email.
